Terms of Service
Overview
These terms cover any work booked with Certified Worx ("we," "us"), a creative media agency providing photography, film and post-production services. By booking a project, requesting a quote, or engaging our services, you agree to the terms below.
Services & Bookings
Project scope, deliverables, timelines and pricing are confirmed in writing (email or a signed quote/agreement) before any shoot day is booked. Verbal discussions and initial enquiries are not binding until confirmed in writing by both parties.
Payment
Unless otherwise agreed, a deposit is required to secure a booking, with the balance due on delivery of final assets. Late payment may delay delivery of final files. Specific terms for your project will be set out in your quote or agreement.
Cancellations & Rescheduling
We understand plans change. Cancellations or reschedules made with reasonable notice are handled case by case. Costs already committed on your behalf (crew, equipment, locations, travel) may not be refundable.
Intellectual Property & Usage Rights
Unless agreed otherwise in writing, Certified Worx retains copyright of raw and unedited footage/images. Final delivered assets are licensed to the client for the use outlined in the project agreement. Certified Worx retains the right to use final work for its own portfolio, website and marketing unless the client has requested otherwise in writing.
Limitation of Liability
We take care on every shoot, but we're not liable for delays or issues caused by circumstances outside our reasonable control (weather, third-party locations, equipment failure beyond reasonable prevention, and similar). Our liability for any claim is limited to the value paid for the relevant project.
Governing Law
These terms are governed by the laws of South Africa, without regard to conflict-of-law principles.
